The purpose of this website is to provide information about the settlement in the class action lawsuit Skrtich, et al., v. Pinnacle West Capital Corp., et al., currently pending in the United States District Court for the District of Arizona (Civil Action No. 22-cv-01753-SMB).

This settlement affects certain participants and beneficiaries of the Pinnacle West Capital Corporation Pension Plan. Specifically, the settlement affects the following defined class:

All participants in and beneficiaries of the Pinnacle West Capital Corporation Retirement Plan (the “Plan”) who began receiving a JSA or QPSA after November 1, 2016 through the date of entry of the Preliminary Approval Order.

Please read the Class Notice carefully to find out what the lawsuit is about, what the terms of the proposed Settlement are, what rights you have to object to the proposed Settlement Agreement if you disagree with its terms, and what deadlines apply.

Important Deadlines

Deadlines Events
October 3, 2025 Any petition by Class Counsel for attorneys’ fees, litigation costs and Case Contribution Award to the Named Plaintiffs, and all briefs in support thereof, shall be filed no later than October 3, 2025.
October 31, 2025 Briefs and other documents in support of final approval of the Settlement shall be filed no later than October 31, 2025.
November 17, 2025, 2024 • The objector or his, her, or its counsel (if any) must file the objection(s) and supporting materials with the Court and provide a copy of the objection(s) and supporting materials to Class Counsel and Defense Counsel at the addresses in the Settlement Notice no later than November 17, 2025.
• If an objector hires an attorney to represent him, her, or it for the purposes of making an objection pursuant to this paragraph, the attorney must also file a notice of appearance with the Court no later than November 17, 2025.
• Any objector who files a timely, written objection may also appear at the Fairness Hearing either in person or through qualified counsel retained at the objector’s expense. Objectors or their attorneys intending to appear at the Fairness Hearing must file a notice of intention to appear (and, if applicable, the name, address, and telephone number of the objector’s attorney) with the Court by no later than November 17, 2025
November 24, 2025 • Any responses to objections shall be filed with the Court no later than November 24, 2025. There shall be no reply briefs.
• Any additional briefs the Parties may wish to file in support of the Settlement shall be filed no later than November 24, 2025.
December 1, 2025 A hearing is scheduled for December 1, 2025 at 10:00 a.m. (30 minutes allowed) to make a final determination concerning, among other things:
• Any objections from Class Members to the Settlement or any aspects of it;
• Whether the Settlement merits final approval as fair, reasonable, and adequate;
• Whether the Action should be dismissed with prejudice pursuant to the terms of the Settlement;
• Whether Class Counsel adequately represented the Class for purposes of entering into and implementing the Settlement;
• Whether the Settlement should be granted final approval; and
• Whether Class Counsel’s application(s) for Attorneys’ Fees and Costs and Case Contribution Award to the Named Plaintiffs is fair and reasonable, and should be approved
